The woman sustained a neck injury requiring surgery to replace a disk with an implant, surgery on her right finger, scar revision procedures, and multiple interventional pain management procedures. Before the accident, she worked as an occupational therapy assistant, a physically demanding job that required helping patients with balance and strengthening exercises and lifting some patients weighing 200 pounds or more. Her injuries now limit her ability to perform daily activities such as walking, bending, lifting, sitting, driving long distances, sleeping comfortably, and handling household chores.
“The physical toll of the crash was devastating, requiring our client to undergo major surgical intervention and face an incredibly challenging road to recovery,” said Mr. Monier. The defense was prepared to argue that the woman's injuries were pre-existing and not caused by the crash, and that she was not disabled or impaired because any injuries stemming from the accident had fully healed. However, the law firm was prepared to demonstrate that the accident was a substantial factor in causing her injuries and that any prior conditions were exacerbated by the collision. They also intended to show that the woman remains permanently disabled and will require ongoing treatment and future surgical care.
